  • Second degree assault: This is a more serious crime and categorized as a Class D felony. You can be charged with this type of assault crime if you intend to cause serious physical injuries to someone and they do indeed suffer serious physical injuries. You can also be charged with this type of assault crime if you used a deadly weapon, assaulted a police officer, nurse or another public servant, or assaulted someone who is elderly.
  • First degree assault: This is the most serious assault crime and is categorized as a class B felony. If you caused serious injury to another person, permanently disabled them, or you caused injury to someone while committing a felony, you can be charged with first degree assault and face a jail sentence up to 25 years.
  • Reckless assault of a child: If you are 18 or older and cause a serious injury to the brain of a child who is less than five years old, you can be charged with this Class D felony and face severe penalties.
  • Sexual assault: This term refers to a range of offenses including but not limited to sexual abuse, sexual misconduct, sexual conduct with a child and forcibly touching.
  • Second degree gang assault: If you caused someone serious physical injury with the help of at least two other people, you can be charged with this Class C felony.
  • First degree gang assault: If you intend to cause serious injury to another person, and you do indeed cause injury, and the offense was committed with the help of at least two other people, then you can be charged with this Class B felony.

Assault charges can also be given for driving your vehicle while under the influence of alcohol and/or drugs and causing an accident. There are two types of vehicular assault in New York. They include:

  • Second degree vehicular assault: If you are under the influence of drugs or alcohol and cause a serious injury to another person, you can be charged with this Class E felony.
  • First degree vehicular assault: If you cause an accident and injury to another person while driving with a blood alcohol level of .18% or more, a suspended or revoked license, a passenger who is under 15 years old, or you have a prior DWI or conviction for vehicular assault or homicide, you can be charged with this Class D felony. This charge can also be given if you injure more than one person.
