How Long Drugs Stay in Your System, and Why It Matters for a DWAI-Drugs Charge
Detection is measured in days, sometimes weeks. Impairment is measured in hours. A drug test can be positive long after a drug stopped affecting you, which is why a positive test alone doesn’t prove someone was impaired while driving.
Detection windows vs. how long effects last
| Drug | Typical urine detection window | Typical duration of effects |
|---|---|---|
| Alcohol | Up to about 12–24 hours; EtG tests up to about 80 hours | A few hours, depending on amount |
| Marijuana (THC) | 1–3 days for occasional use; 30 days or more for heavy daily use | About 2–6 hours when smoked; longer for edibles |
| Cocaine | 2–4 days | Under 1 hour |
| Amphetamine / methamphetamine | 2–4 days | Several hours |
| MDMA (ecstasy) | 1–3 days | 3–6 hours |
| Heroin / morphine | 1–3 days | 3–5 hours |
| Oxycodone | 1–4 days | 4–6 hours (immediate release) |
| Fentanyl | 1–3 days | Varies; often under a few hours |
| Methadone | 3–7 days or more | Many hours |
| Benzodiazepines, short-acting (e.g., alprazolam) | 1–4 days | Several hours |
| Benzodiazepines, long-acting (e.g., diazepam) | Up to 10 days or more | Several hours or longer |
| Zolpidem (Ambien) | 1–3 days | 6–8 hours |
| PCP | 7–14 days | Several hours |
These are typical ranges. Actual windows depend on the dose, how often you use, your metabolism, and the test’s cutoff level. Blood tests usually detect drugs for a much shorter time than urine tests.
Why this matters in New York
- New York has no per se limit for drugs. For DWAI-drugs (VTL 1192.4), the prosecution must prove you were actually impaired.
- Many urine tests detect inactive metabolites, not the drug that affects you. A positive result can show past use, not impairment at the time of driving.
- Police often rely on a drug recognition expert’s evaluation, which is opinion evidence that can be challenged.
- A valid prescription is not a defense if the drug impaired your driving, but it does matter for how the case is presented.

How long does marijuana stay in your system for a drug test?
Typically 1 to 3 days after occasional use, and 30 days or more after heavy daily use. The effects usually last only a few hours.
Can a positive drug test prove I was impaired while driving?
Not by itself. Many tests detect metabolites that remain long after effects wear off. New York requires proof of actual impairment for DWAI-drugs.
Is driving on prescription medication illegal in New York?
Driving while impaired by any drug, including a prescribed one, can be charged as DWAI-drugs. Having a prescription is not a defense to impairment.
