RECENT CASES
LONG BEACH, NASSAU COUNTY DWI CHARGES DISMISSED
Client R.R. was a young law student who made a potential life altering mistake by driving home from a party at a friend's house. The law student was found to have a blood alcohol content of a .13 in addition to having an open bottle of alcohol in the car and marijuana. Due to the numerous factors negative factors involved in the case, the Nassau County District Attorney's office refused to offer the client a reduced plea deal. Therefore, NY DWI attorney Richard Hochhauser moved the court to conduct a suppression hearing. At the hearing, the police officer testified that he pulled the vehicle over for speeding, and estimated that the vehicle was going 50 miles per hour. During cross examination, Attorney Hochhauser got the officer to admit that he was never trained in estimating speeds while his own vehicle was also in motion, as was the case here. Further, Attorney Hochhauser convinced the Court that the vehicle could not have been going 50 miles per hour as the officer claimed, because the Officer said the police vehicle only had to travel 60 miles per hour to catch up to the defendant. At this speed, it would have taken the Officer much longer than he testified to in order to catch up to the defendant. Thus, based on Attorney Hochhauser's arguments, the Court found that the Officer was not credible in estimating the Defendant's speed, and thus the Officer had no basis to pull her over. As such, all of the evidenced in the case was suppressed as "fruit of the poisonous tree" and the entire case was dismissed. As a law student, Client R.R. is now able to start her career with a clean record.
NASSAU COUNTY AGGRAVATED DWI CHARGES DISMISSED
Client R.H. had absolutely no criminal record, and wanted it to stay that way. R.H. was charged with aggravated DWI as he blew a .18% blood alcohol content after being pulled over the by the Nassau County Police Department. At the pre-trial suppression hearing, top New York DWI Lawyer Richard Hochhauser established that the Nassau County Police Department illegally pulled over R.H. even though he never violated the Vehicle and Traffic Law. While the police alleged that the defendant had failed to signal and changed lanes unsafely, Mr. Hochhauser was able to show the court that the government failed to meet its burden, and the officer testimony did not support a finding that the defendant violated the law. Due to a prior conviction, client P.L was facing jail time if he was convicted for his second DWI. STALKING AND HARASSMENT CHARGES DISMISSED

Attorney Hochhauser argued that the allegations in this case, that the Defendant was "following" the officer in a public post office, failed to establish the course of conduct necessary for a stalking allegation. All of the related charges were dismissed along with the stalking charge. Motion practice is a commonly overlooked mechanism to get a dismissal in a criminal case. NASSAU COUNTY DWI CASE DISMISSED
Nassau County Criminal and DWI Lawyer Richard Hochhauser represented accountant client E.S. In this case, E.S. was being charged with a DWI even though he only recorded a BAC of .07. DWI Lawyer Richard Hochhauser conducted a hearing before the Honorable Judge Andrew Engel at 99 Main Street, Nassau County District Court, where he cross examined the officer vigorously, showing the court the obvious inconsistencies in the officer's testimony, and the proposed evidence. TWENTY YEAR OLD FELONY CONVICTION SEALED
Nassau County Criminal Defense Lawyer Richard Hochhauser successfully sealed his client, P.P.'s twenty year old felony conviction for forging medicare documents, by filing a 160.59 motion. B.W. was charged with felony possession of a forged instrument for having multiple fake IDs in his wallet. Mr. Hochhauser proved to the DA that an essential element to a possession of a forged instrument case in New York is the intent to defraud. Here, the Nassau County Police Department searched the defendant's wallet without justification, and found the fake IDs. There was nothing inherent in the Defendant's actions that displayed any intent to defraud. What is a PBT?
A "PBT" is a portabe breath test. In New York and Nassau County, most officers carry a PBT in their vehicles. The PBT is a handheld breathalyzer that is used on the side of the road at the time of the arrest. The purpose of the PBT is to help the officers establish probable cause.
Why was I arrested for DWI if my driving was perfect?
Interestingly, erratic driving is not an element of DWI in New York. Thus, even if someone is is not driving erratically, they can still be convicted of DWI. Still, if someone's driving is unaffected by alcohol, it provides a strong defense to a DWI charge.
What does it mean to be "intoxicated" for a DWI in New York?
The New York pattern jury instructions dictate that:
If I was a .08 BAC, does that mean I'm intoxicated?
No. In New York, it is well established thath a person can be intoxicated with a BAC below .08%, and can have a BAC above .08% without being intoxicated. It is important to understand that just because you blow a .08%, does not necessarily mean that you are intoxicated. Additionally, there are many defenses to show that the BAC reading is artificially high.
Does the prosecutor need an expert to prove that I'm intoxicated?
No. The law in New York is well established that a "layman" or the average person, has the experience to tell whether someone is intoxicated. Consider being at a bar - you don't need any special training to determine whether someone there is intoxicated. Therefore, you will often find that the New York police will all describe the same boilerplate signs of intoxication: red and watery eyes, the odor of an alcholic beverage, unsteadiness, slurred speech.
What is Driving While "Impaired" in New York?
The definition of Driving While Impaired in New York is whether your consuption of alcohol actually impaired, to any extent, the physical and mental abilities which you are expected to possess in order to operate a vehicle as a reasonable and prudent driver.
Does the "odor of an alcoholic beverage" mean I'm intoxicated?
Absolutely not. While the smell of alcohol can be a factor that the police use against you, the odor alone is not enough to convict of driving while intoxicated. Importantly, it is impossible to tell how much a person drank from the odor of alcohol alone. It is also important to note that "alcohol" itself has no odor; rather, the alcohol beverages which we consome have a familiar odor.
Can I be charged with Driving While Intoxicated if my car was parked?
In New York, a person also OPERATES a motor vehicle when such person is sitting behind the wheel of a motor vehicle for the purpose of placing it in operation, and when the motor vehicle is moving, or even if it is not moving, the engine is running.
If I blew over the limit, does that mean I was over the limit while I was driving?
Not necessarily. Even though you may blow a .08, that does not necessarily mean you were a .08 while you driving. Often times, one's blood alcohol content is still on the rise. Therefore, while you may have been a .08 at the police station, you also may have been below the limit while you were actually driving.

Yes, as long as the parking lot has at least four parking spots.
Can I suppress the reading of my chemical breath test?
In New York, there are a number of ways to supress a chemical breath test and prevent it from being used at trial. The most common mechanism is to due a hearing where the officer has to testify that there was requisite probable cause to arrest you and request that you provide a breath sample.
Can the police force me to give a breath test?
No. While there are consequences for refusing to take the breath test, you have a statutory right to refuse to take the test. If you refuse, the police cannot force you to give a sample absent a court order.
