One charge dominates the Westbury list

VTL 340(a) — failure to surrender a suspended licence — is far and away the most common charge in our Westbury files. Add VTL 511 and VTL 512 and suspended licence charges in one form or another account for the clear majority of Westbury cases. Only Hicksville is more concentrated.

VTL 340(a) is widely misunderstood, including on other law firms’ websites. It is not a fine-only offence. It is a misdemeanour, and it is sentenced under VTL 1801: up to $300 and 30 days for a first offence, up to $525 and 90 days for a second within eighteen months, and up to $1,125 and 180 days for a third. You will also see a figure of $1,093 quoted on competing sites. That number does not appear in the statute.

Westbury also has a well above-average share of Spanish-speaking clients. A Westbury case involving a non-citizen driver is worth reviewing for immigration exposure even when the charge itself looks minor, because a string of unlicensed-operation misdemeanours reads very differently to an immigration judge than one does.

How a Westbury case usually starts

That matters for the defence, because it puts two questions in front of everything else: did the officer have a lawful reason to pull the car over, and can the prosecution actually prove you were told your licence or registration was suspended.

The second question is the one people lose on needlessly. Notice is an element the People must prove, and their proof is almost always a DMV mailing affidavit sent to whatever address the DMV had on file. In People v. Pacer, the Court of Appeals held that affidavit is testimonial — which matters a great deal when the address on the record is one you moved out of years ago.

The DMV adds its own revocation on top of whatever the court does, and getting relicensed afterwards means clearing every underlying suspension, paying the termination fees and, in some cases, sitting out a revocation period before you can even apply. If you drive for work — a CDL, a TLC licence, a delivery job that checks your abstract — that sequence can cost the job long before it costs a fine.
